The Test is physician-ordered only. Patients provide a DNA sample either using a cheek swab (“Swab”), saliva (“Saliva”) or blood sample (“Blood”), or formalin-fixed paraffin-embedded tissue (“Tissue”) then 1800MedTest runs the Test and provides your physician a comprehensive and dynamic report accessible on our Provider Portal ( 1800MedTest the “Services” or “Service”) and are governed by the following terms of service (“Terms” or “Terms of Service”).

The Service is owned and operated by 1800MedTest. The visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), bioinformatics pipeline, specimen collection, and all other elements of the Service (“Materials”) provided by 1800MedTest are protected by all relevant intellectual property and proprietary rights and applicable laws. All Materials contained in the Service are the property of 1800MedTest or our third-party licensors. Except as expressly authorized by 1800MedTest, you may not make any other for further use of the Materials. 1800MedTest reserves all rights to the Materials not granted expressly in these Terms.
Admera’s Cardio and Oncology tests are not available for samples collected in the State of New York.
1800MedTest submits and processes insurance paperwork and claims on behalf of the patient and does not guarantee that the fees we charge for our Services will be reimbursed by an insurance provider.
You agree that you will be responsible for your use of the Service, and you agree to defend, indemnify, and hold 1800MedTest harmless and its officers, directors, employees, consultants, affiliates, subsidiaries, and agents (“1800MedTest Entities”) from and against any and all claims, liabilities, damages, losses and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with (i) your access to, use of, or alleged use of the Service, or (ii) your violation of these Terms or any representation, warranty or agreements referenced herein, or any applicable law or regulation. USER IDS AND PASSWORDS

By logging onto the Website using any password, You represent, warrant and covenant that You are authorized to use such password and to engage in the activities that You conduct thereunder. DISPUTE RESOLUTION AND ARBITRATION
Except for any disputes relating to intellectual property rights, obligations, or any infringement claims, any disputes with 1800MedTest arising out of or relating to the Terms (“Disputes”) shall be governed by New Jersey law regardless of your state or country of origin or where you access 1800MedTest, and notwithstanding of any conflicts of law principles and the United Nations Convention for the International Sale of Goods. Any Disputes shall be resolved by final and binding arbitration under the rules and auspices of the American Arbitration Association, to be held in New Jersey, in English, with a written decision stating legal reasoning issued by the arbitrator(s) at either party’s request, and with arbitration costs and reasonable documented attorneys’ costs of both parties to be borne by the party that ultimately loses. Either party may obtain injunctive relief (preliminary or permanent) and orders to compel arbitration or enforce arbitral awards in any court of competent jurisdiction.
